1. Acceptance of Terms

By accessing or using MarkReply, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.

2. Open Source vs. Managed Cloud

MarkReply operates under a Commercial Open-Source model:

Self-Hosted (AGPLv3): The core engine is open-source. If you self-host, you must comply with the GNU Affero General Public License v3.0.
Managed Cloud: If you purchase a subscription, we provide hosted infrastructure, automated SSL via Caddy, and database management.

3. Customer Responsibilities

As a tenant of our managed cloud, you are solely responsible for the moderation of comments on your domain. You agree not to use our infrastructure to facilitate:

Spam, phishing, or distribution of malware.
Content that violates intellectual property rights.
Illegal or highly abusive activities.

We reserve the right to suspend any tenant account that degrades our infrastructure or violates these terms.

4. Subscriptions and Payments

Managed cloud services are billed on a subscription basis. Payments are processed securely via PayPal. You may cancel your subscription at any time; your service will remain active until the end of your current billing cycle. We do not provide prorated refunds.

5. Limitation of Liability

Our service is provided on an "AS IS" and "AS AVAILABLE" basis. MarkReply shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of the service.
